Terms of Service
Effective October 6, 2026
1. Agreement
These terms are an agreement between you and Tai Qi Stanley Xu, an individual in Ontario, Canada (“Givn”, “we”, “us”), who runs the Givn app and givn.app. By creating an account or using Givn, you agree to these terms and to our Privacy Policy, which explains what we collect and why.
If you don't agree, don't use Givn.
2. Who can use Givn
- You must be at least 13 years old, and old enough where you live to agree to these terms. If you're under 18, a parent or guardian should agree to them with you.
- Use your own name or one your friends know you by, and keep one account per person.
- Keep your sign-in details to yourself. You're responsible for what happens on your account. Tell us at support@givn.app if you think someone else is using it.
- You can't use Givn if you're in a country under a U.S. government embargo, or on a U.S. government list of prohibited or restricted parties.
3. What Givn is
Givn helps you share what you'd like to receive and find gifts for the people you care about. You can keep a wishlist, make short-lived wishes, follow friends, keep private notes about them, and mark an item as one you plan to give.
Givn doesn't sell anything and isn't part of any gift. When you buy something, you buy it from the shop, under the shop's terms. Features may change, and some may be in testing.
We give you a personal, non-transferable licence to use the Givn app on devices you own or control, for as long as you follow these terms. Don't copy, sell, modify or reverse-engineer the app, or use it to build a competing service. Givn's name, logo, app and design belong to Tai Qi Stanley Xu; these terms don't give you any rights to them.
4. Your content
You own what you add to Givn: your profile, wishlist items, photos, wishes, notes and comments (“your content”).
So that Givn can work, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, resize and show your content to the people you've chosen to share it with, and to keep backups. The licence ends when you delete the content or your account, apart from backups we hold for a short time and anything we must keep by law.
You're responsible for your content. Only add things you have the right to share, and don't post other people's private information without their permission.
If someone makes a claim against Givn because of your content or because you broke these terms, you agree to cover Givn's reasonable costs of dealing with it, to the extent the law allows.
5. Community rules
Givn has zero tolerance for objectionable content and abusive users. Don't use Givn to post, send or share:
- harassment, bullying, threats or hate aimed at anyone, including for who they are
- sexual content involving minors, or any sexually explicit content
- violence, self-harm encouragement, or content that's illegal where you or the viewer live
- someone else's private information, or anything you don't have the right to share
- spam, scams, fake accounts, or impersonating someone
Also don't try to get into accounts or data that aren't yours, get around a block, or disrupt Givn for others.
6. Reporting, blocking and removal
- Report: use Report in the ⋯ menu on someone's profile, or press and hold a comment. You can also email support@givn.app.
- Block: use Block in the ⋯ menu on someone's profile. You and they stop seeing each other on Givn, and they aren't told. You can unblock them under ⋯ → Support → Blocked.
- What we do: we review every report within 24 hours, and reported content may be hidden while we do. If something breaks these terms, we remove it, and we may suspend or close the account that posted it, without notice when the harm is serious.
7. Gifts, pledges and links
- Pledges aren't promises. Marking an item you plan to give helps friends avoid buying the same thing. It doesn't oblige anyone to give it, and Givn doesn't guarantee that any gift is bought, sent or arrives.
- Shop links go to other sites. Links on wishlist items are added by users. We don't check them, and we're not responsible for those sites, their prices, or what you buy there.
- Between friends. Anything you arrange with someone through Givn, like who buys what, is between you and them.
8. Ending your account
You can delete your account at any time under ⋯ → Support → Delete account. That removes your profile and content, as described in the Privacy Policy.
We may suspend or close your account if you break these terms, if the law requires it, or if we stop running Givn. Where we reasonably can, we'll tell you first. Sections 4 (for backups and claims), 7, 9, 10, 11 and 12 still apply after your account ends.
9. Disclaimers and limitation of liability
Givn is free and provided “as is” and “as available”. We don't promise it will always be available, error-free, or keep every piece of content forever, so keep your own copy of anything important.
We may pause Givn for maintenance, and we're not responsible for delays or outages caused by events outside our reasonable control.
To the extent the law allows, Givn isn't liable for indirect or consequential losses, for content other users post, or for gifts, purchases or arrangements between users. Our total liability to you for any claim is limited to the greater of the amount you paid us in the past 12 months or CAD $50.
Nothing in these terms limits rights you have that the law where you live doesn't let us limit.
10. Changes, governing law and contact
- Changes: we may update these terms. For a significant change, we'll tell you in the app at least 14 days before it takes effect. If you keep using Givn after that, the new terms apply.
- Governing law: these terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and disputes go to the courts of Ontario, unless the law where you live gives you the right to bring them locally.

11. If you got Givn from Apple's App Store
- These terms are between you and Givn, not Apple. Apple isn't responsible for Givn or its content, and has no obligation to provide maintenance or support for it.
- If Givn fails to meet a warranty that applies to it, you can tell Apple, and Apple may refund what you paid for the app (Givn is free). Apple has no other warranty obligation for Givn.
- Givn, not Apple, handles any claims about the app: product liability, failing to meet a legal or regulatory requirement, consumer protection, and claims that Givn infringes someone's intellectual property.
- You must also follow Apple's terms for apps and any third-party terms that apply when you use Givn.
- Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
12. General
- If any part of these terms can't be enforced, the rest still applies.
- If we don't enforce a term straight away, we haven't given up the right to.
- We may transfer these terms to whoever takes over Givn. You can't transfer them without our permission.
- These terms and the Privacy Policy are the whole agreement between you and Givn about the app.
